NOTICE OF PUBLIC HEARING

A Public Hearing on the following proposed Ordinances will be held before the Finance Committee on Thursday, July 16, 2015 at 6:30 p.m. Council Chambers, 869 Park Avenue, Cranston, RI. pursuant to Section 3.12 of the Charter.

Complete copies of the proposed Ordinances are available for public review at the City Clerk’s Office and the Cranston Central Library and can be viewed on the City’s website cranstonri.com under calendar by clicking on the meeting date.

“Individuals requesting interpreter services for the deaf or hard of hearing must notify the City Clerk’s Office at 461-1000 ext. 3197 seventy-two (72) hours in advance of the hearing date.”

PROPOSED ORDINANCE NO. 6-15-03 IN AMENDMENT OF TITLE 12 OF THE CODE OF THE CITY OF CRANSTON, 2013, ENTITLED “STREETS, SIDEWALKS AND PUBLIC PLACES” (Roadway Excavation Permit Fee)

It is ordained by the City Council of the City of Cranston as follows:

Section 1. Title 12, Chapter 12.04 entitled STREETS AND SIDEWALKS GENERALLY, is hereby amended to read as follows:

12.04.100 - Roadway excavation permits.

A. Non-Utility Company.

1. No person, firm, corporation or other entity shall in any manner make any opening or excavation on, in, upon or under, nor lay any pipe, drain, wire, line, conduit, cable or the like on, in or under any public highway, street, roadway or sidewalk in the city, nor upon any public lands (the jurisdiction over which is not legally reserved to another municipal department) without the prior written consent of the director of public works or his or her designee.

2. No permit shall issue without payment of the following fees:

Water service connection $450.00

Sewer lateral installations 450.00

Storm drain installations 450.00

B. Utility Company.

1. No person, firm, corporation or other entity shall in any manner make any opening or excavation on, in, upon or under, nor lay any pipe, drain, wire, line, conduit, cable or the like on, in or under any public highway, street, roadway or sidewalk in the city, nor upon any public land (the jurisdiction over which is not legally reserved to another municipal department) without the prior written consent of the director of public works or his or her designee.

2. Permits for the installation of any pipe, drain, wire, line, conduit, cable or the like under any roadway or sidewalk shall be issued only to the owner of said wire, line, conduit, cable or the like. Permits for the installation of any pipe, drain, wire, line, conduit, cable or the like shall likewise be issued in the owner’s name only.

3. No permit shall issue without the payment of an administrative and engineering inspection fee in the amount of [seventy-five] one hundred twenty-five dollars [$75.00] ($125.00) per opening.

C. All work shall conform to the “Specifications for Utility Company Repairs to Streets Within the City of Cranston.”

D. The director of public works shall promulgate such specifications, regulations and forms or applications necessary to affect the purposes of this section.

Section 2. This Ordinance shall take effect on its final adoption

PROPOSED ORDINANCE 06-15-04 RATIFYING THE IBPO (International Brotherhood of Police Officers) CONTRACT, LOCAL UNION 301 (FY July 1, 2012 – June 30, 2014)

It is ordained by the City Council of the City of Cranston as follows:

SECTION 1. Pursuant to the provisions of Chapter 28-9.2 of the General Laws of the State of Rhode Island, the City of Cranston has through its corporate officials, bargained collectively with the IBPO Local 301, which is the certified bargaining representative of Cranston Police Officers as set forth in the contract; and the Union and the City of Cranston have reached an understanding respecting the terms of a contract resulting from concession bargaining.

SECTION 2. That the agreement in writing between the City of Cranston and the IBPO Local 301, covering the fiscal years July 1, 2012 through June 30, 2014, a copy of which is attached hereto, is herby ratified, confirmed and approved by this City Council.

SECTION 3. That except as modified by the terms of the aforesaid agreement, the City of Cranston shall retain all powers vested in it by law and its charter over the management, regulation and control of said City police officers.

SECTION 4. This Ordinance shall take effect upon it final adoption.

Fiscal Note:

I hereby certify that it is anticipated that sufficient funds will be available to fund this contract, and I have provided a fiscal impact analysis, in accordance with Ordinance # 2005-57, which is attached hereto.
