CHILD PORN CHARGES

Colonel Steven G. O’Donnell of the Rhode Island State Police announced that Internet Crimes Against Children (ICAC) Task Force arrested Roy Costa, 29, of 122 Park View Boulevard in Cranston, for possession and transfer of child pornography on Dec. 10.

Costa was arraigned later that morning in District Court.

According to state police, the National Center for Missing and Exploited Children (NCMEC) reported that an individual in Rhode Island transmitted images of child pornography, and the connection at 122 Park View was identified as the source.

The ICAC Task Force members executed a search warrant, and according to state police, forensic examination of digital media in the residence revealed images and videos of child pornography. Task Force members then reportedly identified Costa as the person responsible for transferring the images and for additional images located during the search.

If convicted, Costa may be subject to a fine of five thousand dollars or imprisoned for five years, or both. A person found guilty of transferring child porn may be fined $5,000, or imprisoned for 15 years, or both.

The ICAC Task Force investigates child exploitation-related activities. It is administered by the Rhode Island State Police and supports a national network of task forces engaged in investigations of Internet crimes against children. The Task Force is comprised of members of the Rhode Island State Police and detectives from local departments across the state and Homeland Security and special agents from Homeland Security and United States Postal Inspection Services.

DUI SENTENCE

Brandon Borge, 36, of Fall River, was sentenced to 25 years at the ACI with 15 years to serve and the remainder suspended for the April 1, 2012 DUI incident that killed 34-year-old Barbara Ellis and 10 years suspended for the charge of reckless driving-death resulting, with sentences to run consecutively.

A five-year loss of license upon release, a $5,000 fine and mental health and substance abuse counseling were ordered for Borge, who entered a plea of nolo contendere in May. He was remanded to the ACI upon sentencing.

According to the office of Attorney General Peter Kilmartin, had the case proceeded to trial, the state was prepared to prove that Borge was traveling north on Route 2 in Warwick in excess of 90 mph when he passed a Warwick police officer on the side of the road. Seemingly responding to the police officer, Borge is said to have initially slowed down and turned onto Toll Gate Road, but instead of stopping, he made a U-turn and accelerated back on to Route 2 north in excess of 100 mph for more than one mile before he lost control and hit a bridge abutment.

The vehicle burst into flames. Warwick and Cranston police and rescue personnel pulled Borge from the burning vehicle, unaware Barbara Ellis was a passenger.

It was discovered that Borge had two previous convictions for driving under the influence in Florida.

“The conduct by this defendant was nothing short of unconscionable,” Kilmartin said in a release
