NOTICE OF PUBLIC HEARING

A Public Hearing on the following proposed Ordinances will be held before the Ordinance Committee on Thursday, April 11, 2019 at 6:30 p.m. City Council Chambers, 869 Park Avenue, Cranston, R.I. pursuant to Section 3.12 of the Charter.

“Individuals requesting interpreter services for the dear or hard of hearing must notify the City Clerk’s Office at 461-1000 ext. 3197 seventy-two (72) hours in advance of the hearing date.”

PROPOSED ORDINANCE NO. 3-19-02 IN AMENDMENT OF TITLE 2.40.080 OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED “ADMINISTRATION AND PERSONNEL” (Municipal Court – Fines, Penalties and Imprisonment)

It is ordained by the City Council of the City of Cranston as follows:

SECTION 1: Title 2.40.080 entitled “Municipal Court Penalties - Fines-Penalties-Imprisonment” is hereby amended by adding thereto the following:

2.40.080 entitled “Municipal Court Penalties - Fines-Penalties-Imprisonment

Said municipal court may impose a sentence not to exceed thirty (30) days in jail and impose a fine not in excess of five hundred dollars ($500.00) or both, and shall be empowered to punish persons for contempt.

In zoning and minimum housing violations, fines shall start to accrue 30 days after the issuance of the first violation notice, if the violation is not corrected. The court may impose a fine not to exceed $50,000. Fines shall not be reduced or waived by the building inspector, city solicitor or municipal court except in cases of verifiable hardship which shall be documented in writing by the building inspector or court. Examples of verifiable hardship include death, hospitalization and poverty.

SECTION 2. This Ordinance shall take effect upon its final adoption.
