NOTICE OF PUBLIC HEARING

A Public Hearing will be heard before the Safety Services & Licenses Committee on Monday, September 9, 2019 at 6:00 p.m. Cranston Council Chambers, City Hall, 869 Park Avenue, City Hall, Cranston, R.I. pursuant to Section 3.12 of the Charter on the following proposed Ordinance.

“Individuals requesting interpreter services for the deaf or hard of hearing must notify the City Clerk’s Office at 461-1000 ext. 3197 seventy-two (72) hours in advance of the hearing date.”

PROPOSED ORDINANCE NO. 7-19-01 AMENDMENT OF TITLE 5 CHAPTER 44 OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED “BUSINESS LICENSES AND REGULATIONS” (Hawkers and Peddlers)

It is ordained by the City Council of the City of Cranston as follows:

Section 1. Chapter 5.40 entitled "Hawkers and Peddlers Generally” is hereby amended as follows:

5.40.010 - License—Required—Application and issuance—Term.

A. Except as hereinafter provided, all hawkers and peddlers desiring to sell, or offer for sale as hawkers and peddlers, any articles or substances within the city, and all persons desiring to sell or offer for sale any goods, wares, merchandise, [ice cream, fruits or vegetables,] or other articles or substances, on any street in the city, shall first obtain a license therefor, to be issued by the safety services and licenses committee, and to that end shall make application to such committee for such license therefor, respectively, as may be desired. Upon the recommendation or approval of the chief of police in writing, the safety services and licenses committee may issue a license accordingly to such person, respectively, to sell the articles and substances hereinbefore mentioned in such manner as shall be specified in such license, upon any street in the city, or to hawkers and peddlers authorizing them to sell, or offer for sale as hawkers and peddlers, any articles or substances within the city for the period from the date of such license until the last day of March next following such date. Such licenses may be issued subject to conditions imposed by such committee, and made subject to the regulations of the committee.

B. “Mobile food establishments” licensed pursuant to 5.44 are not hawkers or peddlers and are explicity exempted from this Chapter.

Section 2. Chapter 5.40 entitled "Hawkers and Peddlers Generally” is hereby amended as follows:

5.40.020 - Ice cream and lemonade peddlers and hawkers location restrictions

No peddler or hawker selling or distributing [any ice cream, lemonade or] any [other] items shall park or stop his or her vehicle for the purpose of making a sale of said items in an area which is closer than two hundred (200) feet from a school building between the hours of 8:00 a.m. and 3:00 p.m. on days on which school is in session, as measured from the closest point of the property upon which said building is located to the location which said vehicle is parked.

All peddlers and hawkers parking in any allowed area within the city must comply with all of the city's traffic regulations, including, but not limited to, stopping with right wheels to curb, and they shall only be allowed to park for that amount of time which it takes to serve a customer.

Section 3 This Ordinance shall take effect upon its final adoption.
