NOTICE OF PUBLIC HEARING

    A Public Hearing on the following proposed Ordinances will be held before the Ordinance Committee on Tuesday, February 18, 2020 at 7 p.m. City Council Chambers, 869 Park Avenue, Cranston, R.I. pursuant to Section 3.12 of the Charter.

        “Individuals requesting interpreter services for the dear or hard of hearing must notify the City Clerk’s Office at 461-1000 ext. 3197 seventy-two (72) hours in advance of the hearing date.”

PROPOSED ORDINANCE NO.

1-20-01 IN AMENDMENT OF CHAPTER 8.20 OF THE CODE OF THE CITY OF CRANSTON, 2005 ENTITLED “NOISE CONTROL”

 ((Noise Measurements)

 

It is ordained by the City Council of the City of Cranston as follows:

 

Section 1:  Chapter 8.20.010 of the Code of the City of Cranston, 2005, entitled “Noise-Unnecessary, annoying, etc., noises prohibited” is hereby amended as follows:

Section 8.20.010:  D.  Inspections.

 For the purpose of determining compliance with the provisions of this chapter, the chief of police and authorized representatives of the chief of police are authorized to make inspections of all noise sources and to take measurements and tests whenever necessary to determine the quantity and character of noise. Measurements and tests taken by a properly calibrated and tested noise decibel monitoring device installed at the direction of the inspector of buildings, the chief of police or his/her designee may also be the basis for instituting action for any violation of this section.” If any person refuses or restricts entry and free access to any part of a premise, or refuses inspection, testing or noise measurement of any activity, device, facility, motor vehicle, or process where inspection is sought, the chief of police or authorized representatives may seek from the court a warrant for inspection requiring that such person permit entry and free access without interference, restriction or obstruction, at a reasonable time, for the purpose of inspecting, testing or measuring noise. The court shall have power, jurisdiction and authority to enforce all orders issued under the provisions of this chapter.

    Section 2.  This Ordinance shall take effect upon adoption.
