ARTICLE I
IN GENERAL

AN ORDINANCE IN REGARDS TO ALLOWING MUNICIPAL RETIREES TO RETURN TO WORK ON A LIMITED BASIS WITHOUT INTERRUPTING THEIR PENSION BENEFITS

Be it ordained by the City of Warwick:

Section I: Chapter 2, Article I, of the City of Warwick Code of Ordinances is hereby amended by adding the following:

Sec. 2-34. – Temporary, seasonal and non-regular employment of retired city workers.

  1. In order to address unanticipated circumstances impacting City operations, a temporary seasonal need, or a transitional need that is not expected to recur, the city may re-employ, on a non-regular basis, any city employee who retired with a regular, non-disability pension from the municipal employee retirement fund, not including retirees from the sworn police and fire services. The provisions of this section shall not be used in lieu of filling vacancies in funded, full-time positions, or supplanting the overtime opportunities of regular, full-time employees.
  2. No pension contribution shall be taken and no additional benefits shall accrue or be granted for this service, nor will the person be granted any other city benefit except as already provided by their retiree plan with the city. Persons working pursuant to this section will be neither permitted nor paid to work in excess of forty (40) hours in any city work week. Pension payments will be suspended whenever a retired worker employed under this section exceeds seventy-five (75) working days, or one hundred fifty (150) half-days, or six hundred (600) hours, in any one fiscal year; or for the Warwick Public School Department for a period of not more than ninety (90) working days, or one hundred eighty (180) half-days.
  3. This section shall not restrict the working of details for the police department by former police officers who retired with a regular non-disability pension from the Warwick Police Department, as provided under Article X, Section 10-4 of the Charter of the City of Warwick.

Section II: This Ordinance shall take effect upon passage and publication as prescribed by law.
